Biological Resources

GDB specializes in the review and preparation of biological resource technical reports, habitat conservation plans (HCPs), mitigation and preservation strategies for sensitive species, and biological impact assessments for CEQA and NEPA compliance.  

GDB’s attorneys work extensively with biologists to evaluate environmental impacts to sensitive plants; special status invertebrates, fish, birds, and terrestrial wildlife; vernal pools and wetlands; wildlife movement corridors; and habitat preserve design. In addition, GDB assists clients whose projects are subject to Multiple Species Conservation Programs (MSCPs) or require “take” authorization under the federal Endangered Species Act (ESA) or the California Endangered Species Act (CESA). Through its work on biological issues, GDB also has developed expertise in helping clients comply with the Migratory Bird Treaty Act, the Bald and Golden Eagle Protection Act, and the Marine Mammal Protection Act.  

GDB routinely litigates biology issues under CEQA, NEPA, ESA, CESA, and California’s “fully protected species” statutes. In the litigation context, GDB defends the adequacy of biological impact studies and mitigation plans; assists federal agencies in demonstrating the sufficiency of Biological Opinions issued under Sections 7 and 10 of the ESA; and rebuts challenges to approved conservation and restoration programs for sensitive species and their preferred habitat. Through this work, GDB has developed cooperative relationships with the United States Fish and Wildlife Service, the United States Army Corps of Engineers, the National Marine Fisheries Service, the California Department of Fish and Wildlife, and the California Natural Resources Agency.
